We collect information that you voluntarily provide when you register for an account, create a profile, post a project, submit a proposal, communicate through our Platform, or contact us. This may include:
- Account Information: Full name, email address, phone number, company name, and password.
- Identity Verification Information: Government-issued identification documents and related verification data processed through our third-party identity verification service, as required for Tester and Requester accounts.
- Profile Information: Professional biography, qualifications, certifications, work history, portfolio, resume or CV, and publicly available professional information (e.g., LinkedIn profile) you provide or authorize us to use.
- Project Information: Project descriptions, scope of work, budget, timelines, and any files or documents shared between Requesters and Testers through the Platform.
- Payment Information: Billing address and payment method details. Payment processing is handled by our third-party payment processor; Hackybara does not directly store full credit card or bank account numbers on our servers.
- Communications: Messages exchanged through the Hackybara Chat feature, support inquiries, dispute submissions, and any other communications made through the Platform.
- Security Reports and Findings: Reports, findings, and deliverables submitted by Testers to Requesters through the Platform.
1.2 Information Collected Automatically
When you visit or use our Platform, we automatically collect certain information, including:
- Device and Browser Information: IP address, browser type and version, operating system, device identifiers, and screen resolution.
- Usage Data: Pages visited, time spent on pages, links clicked, referring URLs, and navigation patterns.
- Cookies and Similar Technologies: We use cookies, web beacons, and similar tracking technologies to enhance your experience, analyze usage, and support Platform functionality. See Section 7 (Cookies) for more details.
1.3 Information from Third Parties
We may receive information about you from third-party services, including:
- Identity verification providers used to verify Tester and Requester identities.
- Payment processors used to facilitate escrow and payment transactions.
- Publicly available sources, such as LinkedIn, used to support profile creation with your consent.
2.0 How We Use Your Information
We use the information we collect for the following purposes:
- Platform Operations: To create and manage your account, facilitate connections between Requesters and Testers, process payments through escrow, and deliver our services.
- Identity Verification: To verify user identities through our third-party identity verification service as part of our accountability measures.
- Communications: To send you service-related notifications, respond to inquiries, facilitate in-platform messaging, and provide customer support.
- Security and Compliance: To monitor for fraudulent, unauthorized, or illegal activity; enforce our Acceptable Use Policy and Terms of Service; and comply with legal obligations.
- Dispute Resolution: To review and resolve disputes between Requesters and Testers, including review of submitted reports and communications as described in our Terms of Service.
- Platform Improvement: To analyze usage patterns, improve Platform functionality, and develop new features.
- Marketing and Communications: To send newsletters, promotional materials, or updates about Hackybara services, where you have opted in or where permitted by law. You may opt out of marketing communications at any time.
- Profile Moderation: To review, edit, or moderate public-facing profile content for professionalism, accuracy, and platform standards, as described in our Acceptable Use Policy.
3.0 How We Share Your Information
We do not sell your personal information. We may share your information in the following circumstances:
- Between Requesters and Testers: When you engage in a project through the Platform, certain information (such as your name, profile details, and project-related communications) is shared between the Requester and Tester as necessary to facilitate the engagement. All such sharing is subject to the Standard NDA outlined in our Terms of Service.
- Service Providers: We share information with trusted third-party service providers who assist us in operating the Platform, including payment processors, identity verification services, hosting providers, email delivery services, and analytics providers. These providers are contractually obligated to protect your information and use it only for the purposes we specify.
- Dispute Resolution: In the event of a dispute, the Hackybara Dispute Team may access relevant project information, communications, and reports to facilitate resolution. The Dispute Team adheres to the same NDA obligations described in our Terms of Service.
- Legal Requirements: We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
- Business Transfers: In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.
- With Your Consent: We may share your information for other purposes with your explicit consent.
4.0 Data Retention
4.1 General Retention
We retain your personal information for as long as your account is active or as needed to provide you with our services. We may also retain certain information as necessary to comply with legal obligations, resolve disputes, enforce our agreements, and support legitimate business operations.
4.2 Security Reports
All security reports submitted through the Platform are securely deleted from Hackybara systems fourteen (14) days after an engagement is concluded, as stated on our website. This practice is designed to help ensure client information remains confidential. Requesters and Testers are responsible for retaining their own copies of reports as needed.
4.3 Account Deletion
You may request deletion of your account and associated personal information by contacting us at the email address provided in Section 11. Upon receiving a verified deletion request, we will delete or anonymize your personal information within a reasonable timeframe, except where retention is required by law or for legitimate business purposes (such as maintaining records of completed transactions or resolving disputes).
5.0 Data Security
We take the security of your personal information seriously and implement appropriate technical and organizational measures to protect it against unauthorized access, alteration, disclosure, or destruction. These measures include:
- Encryption of data in transit using HTTPS/HSTS.
- Secure escrow payment processing through trusted third-party providers.
- Identity verification through third-party identity services.
- Access controls and monitoring as described in our Acceptable Use Policy.
- Regular review of security practices and platform infrastructure.
While we strive to protect your information, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, but we are committed to taking reasonable and industry-standard precautions to safeguard your data.
6.0 Your Rights and Choices
Depending on your location, you may have certain rights regarding your personal information, including:
- Access: The right to request a copy of the personal information we hold about you.
- Correction: The right to request correction of inaccurate or incomplete personal information.
- Deletion: The right to request deletion of your personal information, subject to legal and contractual obligations.
